General terms and conditions of sale
1. PREAMBLE
On the one hand, the company La boutique de Lulu (hereinafter referred to as "the site" whose headquarters is located in Brain-sur-Longuenée (49220), declared under SIRET number 523 684 769 00020 and can be reached by mail at the following address: laboutiquedelulu@outlook.com.
All orders placed on the site are subject to these terms and conditions of sale. The Company La boutique de Lulu reserves the right to adapt or modify at any time the general conditions of sale, so it is necessary that they are reread at each visit of the site. The version applicable to any transaction is the one appearing online on the www.laboutiquedelulu.fr website at the time of the order. We consider that by validating your order, you accept our general terms and conditions of sale without reservation after having read them.
Lulu's shop is committed to respecting all the provisions of the Consumer Code relating to distance selling.
2. THE CUSTOMER
The Customer declares to be a natural person, at least 18 years of age and to have the legal capacity or to be the holder of a parental authorization allowing him/her to make an order on the site.
When registering the Customer's personal data in the "my account" section, the Customer must ensure the accuracy and completeness of the mandatory data he provides. In case of error in the wording of the recipient's contact information, the Company La boutique de Lulu cannot be held responsible for the impossibility to deliver the product. The Company La boutique de Lulu reserves the right to cancel any order when the customer's IP address will be domiciled in a different country from the billing and/or delivery address.
3. PRODUCTS
The characteristics of the products offered for sale are presented in the "Catalogue" section of our site. The photographs and descriptions of the products are as accurate as possible but cannot ensure a perfect similarity with the product, particularly with regard to colours. However, if errors or omissions could occur as for this presentation, the responsibility of La boutique de Lulu could not be engaged. The photographs and the texts illustrating the products are not contractual.
All the texts and images presented on the site of the company La boutique de Lulu are reserved, for the whole world, under the copyright and intellectual property rights: their reproduction, even partial, is strictly forbidden.
4. ORDER
The order taking on the Site is subject to the respect of the procedure set up by Lulu's boutique represented by a succession of steps that the Customer must imperatively follow to validate his order. The customer will have the possibility, before definitively validating his order, to check the details of his order and its total price, and to correct possible errors, in particular regarding his delivery address, before confirming it to express his acceptance. Any order confirmed by the Customer shall constitute a contract of sale and acceptance of these conditions.
The boutique de Lulu will refuse any order from a customer with whom there is a dispute or an incident relating to the payment of a previous order or which contravenes the provisions hereof.
In this case, La boutique de Lulu will inform the Customer by e-mail. If the customer does not proceed with the correction of the erroneous elements or contrary to the present general conditions of sale, La boutique de Lulu reserves the right not to treat the order.
Lulu's shop commits to send a confirmation email summarizing the order (products, price, quantity, discounts...) to the email address provided when ordering. To this end, the Customer formally accepts the use of email for the confirmation by La boutique de Lulu of the content of his/her order.
5. PAYMENT
The Internet user can place an order on this site and can pay by credit card ((Carte Bleue, Visa, MasterCard, American Express) shipping after receipt of payment). Payments by credit card are made by means of secure transactions provided by the service providers: Paypal & Stripe The publisher of this site has no access to any data relating to the user's means of payment. The payment is made directly in the hands of the banking establishment.

6. DELIVERY
Orders are delivered by La Poste in metropolitan France, in the French overseas departments and territories and throughout Europe. The shipment is made within 24 to 72 working hours from the perfect collection of the price corresponding to the counterpart by the seller. In case of unusual delay in the processing of products, an e-mail will be sent to you.
The product is delivered to the billing address unless otherwise specified in the fields provided for this purpose when placing the order.
The user will not be able to ask for compensation in case of late delivery by the carrier. Moreover, in case of anomaly at the reception (damaged parcel, opened...), the user will have to file his claim to the carrier within 2 working days, by registered mail, a copy of which will be sent to La boutique de Lulu. If the user is present at the time of delivery, he will have to indicate to the deliveryman the reserves he has. These delivery problems are to be solved in priority with the carrier, La boutique de Lulu cannot be held responsible.
Choice of delivery :
- Letter with tracking (sent by mail at the time of shipment): Deposit in mailbox. No insurance in case of loss/theft/deterioration of the post office. Goods always travel at your own risk.
- International letter with follow-up: Mailbox deposit. No insurance in case of loss/theft/deterioration of the mail.
- Colissimo against signature: Delivery against signature - Full refund in case of loss/theft/damage after response and confirmation by the Post Office.
- Colissimo against international signature: Delivery against signature - Full refund in case of loss/theft/damage after response and confirmation by the Post Office.
- Mondial Relay: parcel made available in the chosen collection point at the time of payment. Full refund in case of loss/theft/deterioration after response and confirmation by Mondial Relay.
La Boutique de Lulu reserves the right to modify the delivery method - Any order over 50€ is systematically delivered against signature.
Goods always travel at the risk of the recipient.
In case of incomplete address or wrong delivery address provided by the customer, the new shipment will be charged in addition to the order.
This being said, despite all the care taken by La boutique de Lulu in the preparation of packages, it is possible that a product may be missing.
Similarly, after the package has been shipped, one of the products may prove to be defective.
This is why, at the reception of his order, the customer will make sure to check the conformity of the received products.
The Lulu boutique reserves the right to modify the list of these countries at any time.
"TRACKING YOUR ORDER"
Order tracking: You can follow the progress of your order in real time in the "my account" section of the Lulu boutique website.
Here are the 3 order statuses:
- "payment accepted" Your order is waiting to be prepared.
- "Your order is being prepared.
- "order shipped" Your package has left our premises and is in the process of being delivered.
If you have opted for sending by letter Max or colissimo you can follow its evolution on the website of the chosen carrier: http://www.csuivi.courrier.laposte.fr/ and http://www.colissimo.fr/portail_colissimo/suivre.do?language=fr_FR.
NB: a delay of 24 to 48 hours may be necessary on the carrier sites before the status of the package appears. The delivery times indicated above are to be taken into account from the time the package leaves our premises. It should be noted that laboutiquedelulu.fr cannot be held responsible in the event of late delivery.
Claims: For any complaint, please contact our services. All claims relating to a defect in the goods delivered, an inaccuracy in the quantities or their incorrect reference in relation to the accepted offer or the order confirmation by laboutiquedelu.fr must be made to laboutiquedelu.fr by e-mail no later than one day after receipt of the package: laboutiquedelulu@outlook.com.
After obtaining the return agreement, the buyer has a period of fourteen days to return the defective goods properly protected, necessarily in a letter with tracking, to laboutiquedelulu.fr. After verification and acceptance of your return, a refund will be made after receipt of the defective item, within 48 hours.
7. RETURNS, WITHDRAWALS AND REFUNDS
The Customer has a period of fourteen clear days to exercise his right of retraction, without having to justify his reasons or pay any penalties except for the return costs, from the delivery of the order and which will be exercised by the return, obligatorily in a letter with follow-up, at his expense of the new products (not worn, not washed) accompanied by the order number to the following address:

Where the fourteen-day period expires on a Saturday, Sunday or public holiday or non-working day, it shall be extended until the first following working day. Products returned incomplete, degraded or soiled by the buyer will not be taken back.
Refunds of products will be made within a maximum period of 30 days after receipt by it of the said products. Refunds will be made according to the same method of payment chosen by the customer at the time of his order.

9. LIMITED LIABILITY
Lulu's shop, in the process of selling online, is bound only by an obligation of means; its liability cannot be held liable for any damage resulting from the use of the Internet such as data loss, intrusion, viruses, disruption of service, or other unintended problems.
The photographs, texts or characteristics illustrating the products are not contractual and thus could not engage the responsibility of La boutique de Lulu.
The responsibility of La boutique de Lulu with regard to the sale of the Products to the Buyer is limited in any case to the amount paid by the Buyer.
The responsibility of La boutique de Lulu will not be able to be implemented for the inexecution of a contract in case of unavailability of a product, of force majeure usually recognized by the French jurisprudence.
10. INTELLECTUAL PROPERTY
All elements of the site, whether visual or audio, including the underlying technology, are protected by copyright, trademarks or patents. They are the exclusive property of La boutique de Lulu.
The user who has a personal website and who wishes to place, for personal use, on his site a simple link directly to the homepage of the Site, must request permission from The Lulu Store.
On the other hand, any hypertext link to the Site using the framing or in-line linking technique is strictly forbidden. In all cases, any link, even tacitly authorized, must be removed upon request from La boutique de Lulu.
Hypertext links may refer to sites other than the site. La boutique de Lulu disclaims all liability in the event that the content of these sites contravene the laws and regulations in force.
11. PARTIAL INVALIDITY
In the event that one of the clauses of this contract is null and void by a change in legislation, regulation or a court decision, this shall in no way affect the validity and compliance with these general conditions of sale.
